Copyright & DMCA Policy

1. Respect for Intellectual Property

PromoForge (operated by Funstar Digital, ABN 30 577 818 671) respects the intellectual property rights of others and expects our users to do the same. We respond to notices of alleged copyright infringement in accordance with the Australian Copyright Act 1968 and the U.S. Digital Millennium Copyright Act (DMCA) where applicable.

2. User Responsibility

You are solely responsible for ensuring that content you upload, generate, or distribute through PromoForge does not infringe any third party's copyright, trademark, or other intellectual property rights. This includes:

  • Images, logos, and brand assets you upload
  • Text, captions, and scripts you provide as input
  • Content you distribute via connected social media platforms

AI-generated content may inadvertently resemble existing works. You are responsible for reviewing all generated content before publication.

3. AI-Generated Content

PromoForge uses third-party AI models (including Anthropic Claude, Replicate, and ElevenLabs) to generate text, images, video, and audio content. While these models are designed to create original output:

  • We cannot guarantee that AI-generated content will not resemble existing copyrighted works
  • You are responsible for reviewing generated content before use
  • PromoForge is not liable for copyright claims arising from AI-generated output
  • If you become aware that generated content may infringe on existing rights, you should discontinue use of that content immediately

4. Reporting Copyright Infringement

If you believe that content hosted on or generated through PromoForge infringes your copyright, please submit a takedown notice to our designated agent with the following information:

  1. A description of the copyrighted work you claim has been infringed
  2. A description of the material you claim is infringing and its location on our platform (URL, user account, or output ID if available)
  3. Your contact information (name, address, telephone number, and email)
  4. A statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law
  5. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on behalf of the owner
  6. Your physical or electronic signature

5. How to Submit a Takedown Notice

Send your copyright takedown notice to:

We aim to respond to all valid takedown notices within 5 business days.

6. Counter-Notification

If you believe your content was removed in error or is not infringing, you may submit a counter-notification including:

  1. Identification of the material that was removed and its former location
  2. A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification
  3. Your name, address, and telephone number
  4. A statement consenting to the jurisdiction of the Federal Court of Australia (or relevant U.S. Federal District Court if applicable)
  5. Your physical or electronic signature

7. Repeat Infringers

PromoForge will terminate the accounts of users who are found to be repeat infringers. We track copyright complaints per account and may issue warnings before termination at our discretion.

8. Content Moderation

PromoForge employs automated content filtering to prevent the creation of content that violates our Acceptable Use Policy. This includes blocking prompts that attempt to generate illegal, harmful, or infringing material. However, automated systems are not infallible, and user vigilance remains essential.
